FERPA Records Requests: What Schools Must Know

Under FERPA, schools must respond to eligible records requests within 45 days. When releasing records, the response must be in writing and should document what was provided and in what format. When denying a request, the denial letter must state the specific legal basis and inform the requestor of their right to appeal.

A common source of compliance risk is the partial release scenario — where some records can be released but others cannot (for example, a file that contains both the requesting parent's child's records and references to third-party students). Schools must document exactly which records were withheld and why, to defend any subsequent appeal or OCR complaint.
